Ivory is an AI-powered tag management assistant designed to help users create and manage Adobe Tags (formerly Adobe Launch) components using natural language descriptions. The Service consists of:
Ivory uses artificial intelligence to generate rule configurations, data elements, conditions, actions, and other Adobe Tags components based on user input.
Ivory is an independent third-party tool and is not affiliated with, endorsed by, sponsored by, or officially connected with Adobe Inc. or any of its subsidiaries or affiliates. Adobe, Adobe Tags, Adobe Launch, Adobe Experience Cloud, and Adobe Reactor are trademarks of Adobe Inc.
Ivory integrates with Adobe's Reactor API and other third-party services to provide its functionality. We do not control these external services and cannot guarantee their availability, accuracy, or continued compatibility. You acknowledge and agree that:
Ivory utilizes artificial intelligence (including Claude by Anthropic) to generate tag configurations. AI-generated content may contain errors, inaccuracies, or unexpected results. You are solely responsible for reviewing, testing, and validating all generated components before deploying them to production environments.

You are responsible for all activities that occur under your account. You agree not to share your account credentials with others or allow others to access your account.
Ivory is offered as a paid subscription service. Subscription details, pricing, and features are available on our website and may be updated from time to time.
Subscriptions are billed on a monthly recurring basis. By subscribing, you authorize us to charge your designated payment method for all applicable fees.
You may cancel your subscription at any time through your account settings or by contacting us at admin@moonbird.ai. Upon cancellation:
Refunds for circumstances other than standard cancellation will be handled on a case-by-case basis at our sole discretion. To request a refund, please contact admin@moonbird.ai.
We reserve the right to modify subscription pricing at any time. Price changes will take effect at the start of your next billing cycle following notice of the change.
From time to time, we may offer free or discounted access to select users for testing, promotional, or evaluation purposes. Such access is provided at our sole discretion and may be subject to additional terms, time limitations, or conditions as specified at the time of the offer.
We collect analytics data through our backend systems to understand how users interact with Ivory, improve our services, and ensure system reliability. This analytics data may include usage patterns, feature utilization, and performance metrics.
By using Ivory, you acknowledge and agree that we collect and store the prompts you submit to the Service. This data is used to:

Moonbird retains all right, title, and interest in and to Ivory, including all software, technology, documentation, trademarks, and other intellectual property associated with the Service.
You retain full ownership of all Adobe Tags components, rules, data elements, and other configurations generated through your use of Ivory. We claim no ownership rights over the output created using your prompts and inputs.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Ivory solely for your internal business purposes during your active subscription period.
If you provide us with feedback, suggestions, or ideas regarding Ivory, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into our products and services without any obligation to you.
You agree not to:
Decompile, disassemble, reverse engineer, or attempt to derive the source code, algorithms, or underlying structure of Ivory or any part thereof.
Sell, resell, rent, lease, sublicense, distribute, or otherwise transfer your rights to use Ivory to any third party, or use Ivory to provide services to third parties without our express written consent.
Attempt to bypass, circumvent, or disable any security features, usage limits, access controls, or other restrictions implemented in Ivory.
Access or attempt to access any systems, data, or accounts that you are not authorized to access, including other users' accounts or Moonbird's internal systems.
Use Ivory for any illegal purpose, to transmit malicious code, or in any manner that could damage, disable, or impair the Service or interfere with other users' access to or use of the Service.
Misrepresent your identity, affiliation, or authorization to access Adobe Tags properties or other systems accessed through Ivory.
Ivory is provided on an "as available" basis. We do not guarantee any specific level of uptime, availability, or performance. We will use commercially reasonable efforts to maintain the Service but make no commitments regarding service levels.
We may perform maintenance, updates, or modifications to Ivory at any time, which may result in temporary service interruptions. We will endeavor to provide advance notice of planned maintenance when feasible.
We reserve the right to modify, suspend, or discontinue any aspect of Ivory at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
You may terminate your account at any time by canceling your subscription and ceasing use of Ivory.
We reserve the right to suspend or terminate your access to Ivory at any time, with or without cause, and with or without notice. Grounds for termination may include, but are not limited to:
Termination decisions will be made on a case-by-case basis, and we may, at our discretion, provide warnings or opportunities to cure violations before termination.

IVORY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT IVORY WILL MEET YOUR REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM USING IVORY WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS, INACCURACIES, OR PRODUCE UNEXPECTED RESULTS. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VALIDATING ALL OUTPUT BEFORE USE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOONBIRD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE IVORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONBIRD'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF IVORY SHALL NOT EXCEED THE AMOUNT YOU PAID TO MOONBIRD FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
You agree to indemnify, defend, and hold harmless Moonbird and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Before initiating any formal dispute resolution proceeding, you agree to first contact us at admin@moonbird.ai to attempt to resolve any dispute informally. We will work in good faith to resolve any issues within thirty (30) days.
If we cannot resolve a dispute informally, you and Moonbird agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or Ivory through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New Hanover County, North Carolina, or at another mutually agreed location.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
YOU AND MOONBIRD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
You may opt out of the arbitration agreement by sending written notice to admin@moonbird.ai within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in New Hanover County, North Carolina.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moonbird regarding Ivory and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
We may provide notices to you via email, posting on the Service, or other reasonable means. You may provide notices to us at admin@moonbird.ai.
Section headings are for convenience only and shall not affect the interpretation of these Terms.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service prior to the changes taking effect. Your continued use of Ivory after any changes indicates your acceptance of the modified Terms.
